Donald Kaczkowski

In order to make every client feel like the firm’s only client, Donald Kaczkowski strives to bring a certain mix of energy and understanding to the individuals and businesses he represents. In his well-rounded litigation practice, he relies on a sharp attention to detail in order to quickly digest facts and issues to efficiently satisfy a client’s needs. Donald litigates or arbitrates on a variety of commercial matters for clients, including contract and general business disputes, insurance defense, and creditors’ rights and bankruptcy issues. He also assists clients with transactional matters, such as non-competition agreements, loans, entity selection and formation, and in general business operations.

While a native of San Antonio, Donald calls Fort Worth his home and is a devoted fan and follower of the Rangers and Cowboys. If he’s not in the office or watching sports, he might be working out at the Fort Worth Club. Donald and his wife and fellow attorney, Mayella, are also enthusiastic scuba divers and enjoy traveling with friends and family. They are also proud parents to their young son, Alex.

Representative Experience & Services

Donald litigates in several areas of the law relating to commercial and business disputes, among which are insurance defense, personal injury, and creditors' rights and bankruptcy. Some services and experiences include:

  • Representing clients in state and federal courts across Texas, as well as resolution through arbitration
  • Defending lawsuits against employers involving personal injury claims, including negligence and premises liability
  • Representing businesses in disputes, including breach of contract, tortious interference, fiduciary duties, and fraud
  • Prosecution of commercial claims for misappropriation of trade secrets, breach of contract and non-competition agreements, civil theft, and fraud
  • Representation of a national financial institution as lead counsel for collection and bankruptcy matters
  • Representation of a variety of financial institutions and businesses on commercial collections, foreclosures, and bankruptcy issues
  • Representation of secured and unsecured creditors in bankruptcy proceedings, including objections to confirmation, motions to lift the automatic stay, sales of assets, and litigation involving the non-dischargeability of debt and other types of adversary proceedings
  • Representing clients in arbitration proceedings involving personal injury defense and business disputes
  • Counsel on litigation avoidance

Donald also maintains a significant portion of his practice directed toward non-subscriber to workers’ compensation law, an aspect of labor law unique to Texas.

Although his practice mainly leans toward litigation, Donald also assists individual owners and business partners on key business transactions, including:

  • Negotiating and documenting employment agreements, buy-sell agreements, and loans
  • Business entity selection, formation, and general operations
  • Buy-outs
